South Africa's Financial Regulator Prioritizes Global Alignment in AI Policy, Delays Local Rules

South Africa's Financial Sector Conduct Authority (FSCA) has announced it will defer the development of its own artificial intelligence regulations for the financial sector, opting instead to await the release of global principles from the Financial Stability Board (FSB). This strategic decision, articulated by Commissioner Unathi Kamlana, aims to ensure South Africa's regulatory framework is aligned with international standards, a move that could benefit large South African banks operating globally by reducing compliance costs.

The FSCA, in collaboration with the Prudential Authority and the South African Reserve Bank, plans to use the forthcoming FSB guidance to inform a joint discussion paper. This paper will specifically address the complexities of 'agentic AI' – autonomous systems that execute transactions and make decisions with minimal human oversight – and lay the groundwork for future regulatory approaches. This focus on agentic AI is particularly relevant given its increasing deployment by South African banks, with Absa already piloting such systems.

While South Africa prioritizes alignment, other African nations are proceeding with their own AI regulatory timelines. Egypt has an active AI regulatory sandbox, Nigeria is advancing an AI control and regulation bill, and Mozambique anticipates cabinet-level AI regulation soon. This divergence highlights varied approaches across the continent to managing AI's rapid evolution. The FSCA's current market scan reveals significant AI adoption in South African banking and fintech, yet a lack of uniform governance, underscoring the need for a considered regulatory framework.
